5 FCRA Rights Every Consumer Should Know
1. The right to dispute. You can challenge any item on your credit report. The bureau has 30 days (sometimes 45) to investigate and must remove anything that cannot be verified.
2. The right to a free credit report. Every 12 months from each of the three bureaus at AnnualCreditReport.com, plus an additional free report any time you are denied credit.
3. The right to know who has pulled your report. Anyone who pulled your credit must be listed in the inquiry section. Inquiries you did not authorize can be disputed and removed.
4. The right to time-limited reporting. Most negative items must be removed after 7 years. Chapter 7 bankruptcies after 10. Anything older is illegal to report.
5. The right to sue for violations. If a bureau or furnisher willfully violates the FCRA, you can recover actual damages, statutory damages up to $1,000 per violation, attorney fees, and punitive damages.
Most consumers never use these rights because the dispute process is technical and the bureaus push back hard. That is exactly why credit repair professionals exist — to use the law the way it was designed to be used.
